Dans certaines situations, un ressortissant français peut perdre sa nationalité française.

In certain situations, a French citizen may lose his or her French citizenship.

 

Mariage d’une Française à un étranger (loi du 26 juin 1889)

Marriage of a French woman to a foreigner (law of 26 June 1889)

 

Selon la loi du 26 juin 1889, applicable entre 1889 et 1927, une Française qui se mariait avec un étranger perdait sa nationalité française.

Under the law of 26 June 1889, in force between 1889 and 1927, a French woman who married a foreigner lost her French citizenship.

 

La raison pour cette perte était que, la femme acquérant la nationalité de son mari, elle ne pouvait pas garder la nationalité française.

The reason for this loss was that, as the wife acquired the citizenship of her husband, she could not keep French citizenship.

 

 

En effet, à cette époque, les doubles nationalités n’étaient pas encore reconnues.

Indeed, at this time dual citizenship was not yet recognized.

 

 

La seule exception à cette perte de nationalité en raison du mariage avec un mari étranger était si, la femme ne pouvait pas acquérir la nationalité du mari.  Dans ce cas, elle restait française.

The only exception to this loss of citizenship by virtue of marriage to a foreign husband was if, the wife could not acquire her husband’s citizenship.  In this case, she remained French.

 

La loi de 1889 prévoyait néanmoins la possibilité pour la femme de retrouver (ou être “réintégrée”) la nationalité française, si le mariage prenait fin avec la mort du mari ou le divorce, et la femme demandait la réintégration dans la nationalité française.

The 1889 law provided however for the possibility for the wife to regain (or be “reintegrated”) French citizenship, if the marriage ended with the death of her husband or divorce, and the woman requested reintegration into French citizenship.

 

Mais, pour demander la réintégration, il fallait qu’elle réside ou rentre en France pour y habiter.

But to request reintegration, it was necessary that she reside or return to France to live there.

 

Si la demande de réintégration de la femme était acceptée par les autorités françaises, un décret de réintégration était émis.

If the request for reintegration of the woman was accepted by French authorities, a decree of reintegration was issued.

 

Ce décret de réintégration pouvait d’ailleurs accorder la nationalité française aux enfants mineurs de la femme, si son mariage avait pris fin à la suite de la mort de son mari.

This decree of reintegration could in addition confer French citizenship on the minor children of the woman, if her marriage had ended following the death of her husband.

 

Perte de nationalité après 50 ans

Si vous, votre grandparent et parent Français avez habité à l’étranger depuis plus de 50 ans, il convient de vérifier si vous avez perdu la nationalité française en raison d’une absence prolongée de documents officiels de Français (“possession d’état”).

If you, your French grandparent and parent have lived abroad for longer than 50 years, it is advisable to check if you lost French citizenship as a result of the long-standing lack of French official documents (“possession of French status”).

 

C’est la perte de nationalité “par désuétude”. (article 30-3 du code civil)

It is the loss of citizenship “by lapse”. (article 30-3 of civil code)

 

L’idée derrière cette perte est que, même si vous ou votre parent étiez Français par le passé, l’absence prolongée de contacts entre vous ou votre parent et l’Etat français vous a fait perdre votre nationalité.

The idea behind this loss is that, even if you or your parent were French in the past, the long-standing lack of contacts between you or your parent and the French government resulted in the loss of your citizenship.

 

Cherchez  dans vos archives si vous ou votre parent avez eu de documents officiels français, tels que :

  • carte nationale d’identité

  • passeport

  • carte d’électeur

  • pièces militaires

  •  inscription au registre des Français de l’étranger (article 17 du décret n° 93-1362 du 30 décembre 1993)

  • transcription d’un mariage ou naissance auprès du consulat

Bonne pratique : renouvelez votre passeport et carte nationale d’identité, même si vous habitez à l’étranger.  Inscrivez vous auprès du consulat au registre des Français de l’étranger.  Gardez votre carte d’électeur, renouvelez la si besoin.   Déclarez votre mariage et la naissance de votre enfant au consulat. Vos enfants et petits-enfants pourront ainsi garder leur nationalité française.

 

Good practice: renew your passport and national identity card, even if you live abroad.  Register with the consulate in the registry of French nationals abroad.  Keep your voting card, renew it if needed.  Declare your marriage or birth of your child to the consulate.  Your children and grandchildren will be able as a result to keep their French citizenship.
