Conditions de régularisation / Conditions for regularizing

 

Les conditions de régularisation des parents d’enfants scolarisés sont:

  • une “vie familiale établie” en France
  • résidence en France depuis 5 ans
  • scolarisation d’un enfant en France depuis 3 ans, y compris en maternelle

The conditions for regularizing of parents of children in school are:

  • an established family life in France
  • living in France for 5 years
  • child attending school in France for 3 years, including primary school

 

Situation du couple / Couple situation

Les deux membres du couple peuvent être en situation irrégulière, lorsque un enfant est scolarisé.

Both members of the couple can be undocumented, when a child is in school.

 

Si le couple est séparé, la personne isolée doit établir qu’elle contribue effectivement à l’entretien et l’éducation des enfants.

If the couple is separated, the person without the child must show he or she contributes to the education and support of the child.

 

Taux d’acceptation des demandes / Acceptance rate of applications

Si le nombre des demandes de régularisation des parents d’enfants scolarisés est important, le taux d’acceptation est faible.

While the number of applications for regularizing of parents of children in school is large, the rate of acceptance is low.

 

En s’appuyant sur les statistiques sur la régularisation dans le cadre de la circulaire du 13 juin 2006, à peine 6 924 des 33 538 demandes de régularisation ont été acceptées.

On the basis of statistics about regularizing under the circular regulation of 13 June 2006, only 6 924 out of 33 538 applications for regularizing were accepted.

 

Il est préférable, si possible, pour le demandeur de s’appuyer sur le travail, pour sa régularisation, pour bénéficier de plus de chances de voir sa demande acceptée (voir Régularisation pour travailleurs / Regularizing for workers – Luis Wolff kono).

It is preferrable, if possible, for the applicant to rely on work, for his or her regularizing, to benefit from greater chances of having the application accepted (see Régularisation pour travailleurs / Regularizing for workers – Luis Wolff kono).
